The www.nativees.com website is under the exclusive and complete ownership of the company Amajee, SAS with a capital of 1500 €, RSC: 499 797 108 Creteil, APE code: 722C, Resident: 22 rue Maurice Barres 94210 La Varenne St Hilaire, France. Any reproduction wholly or partly of the website is systematically subject to permission of the owners.

Acceptance of terms

The customer acknowledges having read, at the time of ordering, the special conditions of sale stated on this screen and expressly accept them without reservation. These general conditions of sale govern the contractual relationship between www.nativees.com and their clients, both parties accept. These terms and conditions prevail over all other conditions contained in any other document, unless prior express written consent. These conditions of sale can be modified; the applicable conditions are those in force on the site at the time of placing your order. The Customer declares to be at least eighteen (18) years old and to have the legal capacity or hold parental authorization to perform a command on www.nativees.com

Products

The www.nativees.comwebsite lists and describes the products offered with the greatest possible accuracy available. It may happen that errors appear on the site. In the case that a supplied product should prove non-compliant, the www.nativees.com site agrees to correct this error and the buyer may exercise his right of withdrawal or apply the legal guarantee of conformity.

Orders and Availability

www.nativees.com reserves the right to cancel or refuse any order from a customer with whom there is a dispute over payment of a previous order or for any reason whatsoever. The order refusal will be announced by e-mail, fax or by post. When you click to validate after the ordering process you agree with it and all of the terms of sale, freely and unreservedly. We will confirm receipt of your order by e-mail after checking the availability of your order and payment authentication (secure payment system PAYBOX and PAYPAL). The data recorded by www.nativees.com constitute proof of all transactions between www.nativees.com and its customers (secure payment system PAYBOX and PAYPAL). Data recorded by the payment system constitutes proof of financial transactions (secure payment system PAYBOX and PAYPAL). Concerning payment bybank transfer, the order will be considered confirmed only by the receipt of payment. The selection and purchase of a product are the sole responsibility of the buyer. The seller shall not be held liable for any direct or indirect damage through improper use of the products. www.nativees.com makes all necessary efforts to ensure the availability of products, within the limits of available stocks. If certain products turn out to be unavailable after the order, www.nativees.com will inform the purchaser by post or e-mail as soon as possible. The customer can then cancel or exchange the order by return mail or e-mail.

Delivery

The order will be processed upon receipt of payment and dispatched no later than 7 days after confirmation. Delivery times vary according to the requested quantities and the destination set by the French post office, depending on the country of delivery (average delay of Metropolitan France is 48h to 72h) The delivery note provided by the carrier must be signed and dated by the customer upon delivery of the product. This dated and signed delivery note proofs transportation and delivery. All orders placed with www.nativees.com are for personal use of the customers. Clients or addressees are strictly forbidden to partially or totally resell the products. www.nativees.com is clear of all legal responsibilities if the customer does not pay taxes. Delivery will be made through the French post office via Colissimo at the buyer’s expense. Delivery fees are in addition to the agreed price as indicated in the order.

In case of apparent defects, the buyer can return the product in accordance to the conditions provided in this document. According to the article L.121-20-3 of the Consumer Code, www.nativees.com releases itself from all or part of its liability by proving that the non-execution or improper execution is caused by either the consumer, or something unforeseeable and unavoidable, or at last a case of force majeure. Always check your parcel on arrival. You have 3 days to make a claim with the carrier in case of missing or damaged products. Due to product availability, an order can be delivered in several different parcels. The customer only pays for one delivery in that case. If the client wants to place an order to be delivered to two different addresses, he needs to place two separate orders with associated delivery charges. In case of absence at the time of personal delivery, the carrier will leave a notice at the delivery address specified by the customer. The products must be collected at the address and in the manner specified by the carrier. If the customer fails to claim his parcel within the time frame given by the carrier, the product will be returned to www.nativees.com who reserves the right to refund only the purchase price, as delivery charges are the responsibility of the customer. Prices: delivery costs are fixed, regardless of the number of products ordered and depending on the country of delivery.

Retraction

In accordance with ArticleL.120-20 and the Consumer Code, you are allowed seven ( 7 ) working days to exercise your right of withdrawal without having to justify your decision or pay penalties except the cost of the return. The seven-day period applies from the date of receipt of the items. To cancel your purchase during the withdrawal period, you must notify your withdrawal by registered letter and return the article (s) in its (their) original packaging, intact, with all possible accessories, directions for use and documentation to the following address:

Products which are returned incomplete, damaged or deteriorated because of the customer will not be refunded. In case of exercising the right of withdrawal, www.nativees.com is obliged to reimburse the sums paid by the customer (free of charge), except for return costs. Repayment is due within a maximum of 30 days. Upon delivery, the client must verify the content, conformity and the state of the product. In case of error or non-conformity of the article(s), the customer must make a detailed statement in writing and return the article(s) new in its (their) original packaging, intact, with all possible accessories, directions for use and documentation. www.nativees.com will then offer an exchange or refund of the products. Shipping fees will be refunded, based on the invoice price. Return fees will be refunded upon presentation of receipts. You are protected by legal guarantees of conformity and hidden flaws in accordance with the legal conditions of the Consumer Code and the Civil Code.

Price

Product prices are in Euros, all taxes included (VAT), excluding shipping expenses paid by the buyer. Any purchaser and / or addressee, individual and legal entities, excluding the member countries of the European Union is the importer in the country of destination. As such, the importer will be responsible for eventual duties, taxes and other conditions for importation into the country of destination. Declarations, duties, taxes or any benefits related to the importation of products do not fall into the responsibility of www.nativees.com or any other individual and legal entity acting on its behalf. They are the responsibility of the purchaser and under its full responsibility in terms of returns and payments to the competent authorities and bodies in the country concerned. We recommend that you inquire about these issues with representatives of the authorities concerned. All orders, whatever their origin, must be paid in Euros. www.nativees.com reserves the right to change these prices at any time. The products will be invoiced based on rates effective at the time of the order entry.

Payment

By Credit card: via the secure payment system PAYPAL or PAYBOX. Payment is made online by credit card VISA, credit card, e-credit card or Mastercard. We use the most reliable secure online systems available on the Internet. Payment by credit card is an encoded system and www.nativees.com does not retain any information from the customer's card. This information is not communicated to www.nativees.com and is inaccessible by a third party. The order is considered effective after approval of the payment centres and a confirmation by e-mail send by www.nativees.com to the client. By bank transfer: the order is dispatched by www.nativees.com once the transfer is received. The ordered products remain the property of www.nativees.com until final and total payment of the fee according to the terms of Law No. 80335 of 12 May 1980.

Litigation

This contract is subject to French law. www.nativees.com cannot be held liable for damages of any kind, whether tangible or intangible property, which could result from a malfunction or improper use of sold products. In case of difficulties in applying this contract, the buyer has the option, before any legal action, to seek an amicable arrangement with the help ofa professional association of the industry, an association of consumers or any other counsel of his choice. Remember that the search for an amicable arrangement does not break off the time allotted by the legal guarantee nor the duration of the contractual guarantee. In general the respect of the provisions of this contract related to the contractual guarantee assumes the buyer to honour his/her financial commitments to the seller. Any claims or disputes will always be received with careful consideration, good faith is always assumed for those who took the trouble to explain the situation. In case of a dispute, the customers’ first priority is to obtain an amicable agreement with the company. If not the buyer can refer the matter to the court either of the defendant’s place of residence or the place where the goods have been delivered to or the place where the buyer lived at the time the order was placed or the damageable act occurred.

Warranty

www.nativees.com ensures that all selected products comply with French law. In all cases www.nativees.com cannot be held responsible for non-accordance with regulations and laws in force in the receiving country. The responsibility of www.nativees.com is always limited to the value of the product in question, value in force at the date of sale, without possibility of appeal to the brand or manufacturer of the product.
